Travel Conditions

1. Travel Service Agreement and Tour Operator’s Liability – PACKAGE TOUR

These travel conditions are applied in accordance with the Estonian Air Transport Act.

1.1 Virone Travel Agency, as a tour operator, is responsible for ensuring that the trip complies with the description and written promises made to the client.

1.2 Virone Travel Agency is not liable for inaccurate information provided by the Distributor.

1.3 Virone Travel Agency is not liable for damage caused by force majeure (including, but not limited to, natural disasters, political incidents, strikes, etc.).

1.4 Contents of the Agreement

The price of the tour includes only those services that are specified in the tour description, on the invoice or agreed upon between the Tour Operator and the Traveller. The content of the agreement and the deficiencies of the trip are assessed taking into account the information provided by the Tour Operator when selling and advertising the trip.

1.5 Obligation to provide assistance

The Traveller is responsible for obtaining travel insurance. If the Traveller falls ill during the trip, gets into an accident or becomes a victim of a crime, the Tour Operator will assist in arranging treatment and (if necessary) early return. The Tourist undertakes to pay all associated additional costs in the amount of damage caused to the Tour Operator.

1.6 The Passenger is responsible for obtaining insurance in the event of interruption, delay and cancellation of the trip. Virone Travel Agency does not compensate for expenses related to trip cancellation or weather conditions, etc. Expenses related to the cancellation of the trip due to circumstances beyond the control of the Tour Operator, these expenses will be covered by the insurance company if there is insurance, and in the absence of valid insurance, these expenses will be paid by the Traveller.

1.7 Virone Travel Agency is guided in its activities by the conditions established in the Tourism Act, the Law of Obligations Act and other legal acts of the Republic of Estonia.

2. Liability of the travel agency as an intermediary

As a travel agency, the travel agency is not a direct supplier of any services it sells, but only an authorized reseller. Therefore, the Virone travel agency is not responsible for the quality and quantity of services provided by the actual service provider (airline, shipping company, hotel tour operator, car rental company, etc.). If you are not satisfied with the service provided or the service does not correspond to the documents provided to you, you should always first and immediately address your complaint directly to the service provider on the spot. As a rule, in such cases the situation is resolved in favor of the Passenger. If your complaint is not responded to or the requested service is refused, you must send a written statement to your travel consultant addressed to the director of the travel agency no later than 1 week after your return. Unfortunately, the travel agency is not able to process or forward oral complaints. The Traveller must attach to the written complaint original receipts for directly justified additional expenses for which he/she wishes to receive compensation from or through the Travel Agency. Unfortunately, financial claims not related to direct and incurred expenses (moral damage, nervousness, loss of time, etc.) are not subject to reimbursement by either the Travel Agency or any other company.

3. Conclusion of the contract and payment for the trip

3.1 The contract between the Traveller and the Tour Operator becomes binding on both parties from the moment the Traveller selects a tour and makes an advance payment, the amount of which per person is indicated in the tour description. If there are more than 35 days left before the trip, the advance payment must be made no later than 3 days after booking the trip.

3.2 The entire cost of the trip must be paid no later than 35 days before the start of the trip. If the trip order is made later than 35 days before the start of the trip, the advance payment must be made on the same day, and the full cost – within 2 days.

3.3 The tourist’s order becomes binding for the Virone travel agency after the advance payment has been made.

3.4 After paying for the trip, the Passenger has the right to receive the necessary travel documents before the start of the trip. The time of receipt of travel documents will be communicated when concluding the travel agreement.

4. The passenger’s right to cancel the trip

4.1 More than 31 days before the start of the trip, the traveler is obliged to leave 100% of the advance payment as compensation;

4.2 30-22 days before the start of the trip, the traveler is obliged to leave an advance payment as compensation;

4.3 21-15 days before the start of the trip, the compensation will be 50% of the cost of the trip;

4.4 14-8 days before the start of the trip, the tourist is obliged to reimburse 75% of the cost of the trip;

4.5 less than 7 days before the start of the trip no refund

4.6 If the traveller is not issued a visa or is not granted a transit visa for the country of destination of the booked trip and/or the countries through which the trip is to be made, the trip will be considered cancelled without significant impediment and the provisions of paragraph 4.1 of these travel conditions will apply. If the traveller is unable to enter the country because he is not allowed to cross the border, he must pay all costs associated with returning home. Travel costs will not be refunded.

4.7 If the traveller fails to arrive or is unable to travel due to the lack of necessary documents, the cost of the travel will not be refunded.

The traveller may cancel the Travel Service Agreement at any time before the start of the travel.

According to the Estonian Tourism Act, the passenger has the right to cancel the booking and not pay compensation for the travel if there has been a material change to the travel service (Article 872(2) of the Estonian Tourism Act). The traveller must notify of the cancellation of the booking within 48 hours of receiving the notice of a material change.

If the Passenger cancels the Travel Service Agreement, the Passenger undertakes to pay compensation to the Tour Operator:

–In the amount of the prepayment made, if more than 35 calendar days remain before the start of the travel at the time of cancellation;

-50% of the cost of the trip if there are 15-35 days left before the trip

-The full cost of the trip if there are less than 15 days left before the trip

In case of cancellation of a trip by a family or a group of friends traveling together, the cost of which is calculated taking into account a certain number of travelers staying in one room or traveling together, the tour operator has the right to charge an additional fee due to changes.

To avoid complications and inconveniences, we recommend that you take out trip cancellation insurance.

If you cancel your trip for a valid reason (illness, accident, etc.) and you have trip cancellation insurance, the insurance company will reimburse the cost of the trip to the traveler.

5. Obligations and Responsibilities of the Passenger

5.1 The tourist is obliged to comply with the instructions and rules of the tour operator during the trip, as well as the internal rules of hotels and vehicles, and the instructions of the authorities.

5.2 The traveller must not, by his/her behaviour, interfere with other travellers, the successful completion of the trip or damage the reputation of the tour operator. A passenger who grossly violates this rule may be refused admission to the trip or may be removed from the trip without the right to a refund of the cost of the trip.

5.3 The traveller is liable for any damage caused to the tour operator, fellow travellers or third parties by his/her intentional or careless actions. The passenger may purchase separate baggage insurance.

5.4 The passenger is responsible for the validity and safety of personal travel documents.

6. Prices and price changes

6.1 The price of the tour includes only those services that are described in the materials presenting the tour, in the written offer, on the invoice or that have been agreed between the traveller and the tour operator. If the traveller does not use any of the services included in the price, he/she has no right to a refund for them.

6.2 Unless otherwise stated, the price of the trip does not include visas, excursions and travel insurance. Hotel rooms must be vacated by 10:00.

6.3 The tour operator has the right to increase the price of the travel package and is also obliged to decrease the price of the travel package if the following circumstances arise:

6.3.1 Changes in taxes, fees and service charges in Estonia or the country of destination, if they affect the price of the trip;

6.3.2 In the event of changes in transport prices, if they are beyond the control of the tour operator and which could not have been foreseen when planning the trip;

6.3.3 Changes in exchange rates.

7. Errors in travel arrangements and reporting thereof

7.1 The tour operator is liable if the trip and the services offered do not correspond to the description of the trip and the promises made to the traveller.

7.2 Minor changes in terms of the trip as a whole, which could be expected given the purpose and nature of the trip, cannot be considered as deficiencies.

7.3 A change in the travel schedule cannot be considered a defect if the change is caused by circumstances beyond the control of the tour operator and does not exceed 8 hours.

8. Elimination of defects

8.1 The traveller is obliged to immediately notify the tour operator’s representative at the destination of any defects or complaints regarding the travel arrangements.

8.2 The tour operator is obliged to immediately correct any error made. The tour operator does not have the right to correct the error during the travel if this proves impossible or entails disproportionate costs.

8.3 If the defect has not been corrected for the above-mentioned reason, the traveller has the right to compensation proportional to the amount of the defect in the total price of the package.

9. Compensation for damage

9.1 The tour operator compensates for damage caused to the health and property of the traveller if it has arisen as a result of the actions of the tour operator or its representative.

9.2 If the error has been corrected and the damage caused has been compensated at the destination, the passenger has no right to demand repeated compensation in Estonia. Damage will be compensated in proportion to the damage caused.

9.3 The tour operator is not liable for damage caused by force majeure circumstances.

9.3 The tour operator is not liable for damage caused by force majeure.

9.4 The tour operator is not liable for damage caused by the actions and negligence of the traveller.

9.5 The tour operator is not liable if the traveller becomes a victim of a crime.

9.6 Claims and demands for compensation for damage must be submitted in writing during the trip or no later than 5 working days after the end of the trip.

10. Validity and interpretation of travel conditions

10.1 These travel conditions become binding on both parties from the moment the travel contract is concluded (Section 3.1).

10.2 Disagreements arising from the interpretation of the travel conditions shall be resolved through negotiations between the traveller and the tour operator. If agreement is not reached, the Consumer Protection and Technical Regulatory Authority (TTJA) has the right to resolve the disagreement. If agreement is not reached in this way, the disagreement will be resolved in accordance with the procedure established by the legislation of the Republic of Estonia.
